Beta Evaluator Terms

These terms apply to anyone using TurbineX while the platform is in its Beta Evaluator / Early Adopter programme. They sit alongside the general Terms of Service and the Privacy Policy and govern only the period of beta use.

1. Acceptance and scope

By creating an account or otherwise accessing TurbineX during the beta period you are a "Beta Evaluator" or "Early Adopter" and agree to these terms. Where these terms conflict with the general Terms of Service, these terms control with respect to your beta use until the beta period ends.

2. Status of the service

TurbineX is pre-general-availability software. Features, APIs, data schemas, plan structures, and pricing may change without notice. We will give reasonable notice of changes that affect data durability or access, but we do not commit to a stable surface until general availability.

3. Licence to use

Subject to your compliance with these terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use TurbineX during the beta period solely for the purpose of evaluating the platform and providing feedback. You may not (a) resell, rent, lease, or sublicense access to the service; (b) reverse-engineer, decompile, or attempt to derive source code from any part of the platform; (c) create derivative works based on the platform, its output formats, or its documentation; or (d) use the service to develop a competing product. This licence terminates automatically when the beta period ends or when these terms are terminated under Section 13.

4. Availability and support

We aim for high availability but make no service-level commitment during the beta. Planned maintenance, unplanned outages, and individual feature regressions are expected. Support is offered on a best-effort basis via contact@turbinex.app; current status is published at status.turbinex.app.

5. Complimentary use and tokens

Beta Evaluators receive complimentary compute tokens on the Beta plan throughout the beta period. No fees apply unless you choose to upgrade to a paid plan. We may adjust complimentary allocations with reasonable notice if a Beta Evaluator's usage materially exceeds normal evaluation patterns.

6. Data handling and retention

Beta-plan retention applies (currently seven days for simulation outputs). Beta Evaluators are responsible for exporting any results they want to keep beyond the retention window. At the end of the beta period we may reset or migrate beta data; we will provide at least 30 days' notice and a documented export path before doing so. Personal data is handled in line with the Privacy Policy.

7. Personal data and GDPR

We process personal data (including evaluator name, work email, organisation, and usage metadata) in accordance with Regulation (EU) 2016/679 (“GDPR”) and Greek data protection law. The lawful basis for processing during the beta is (a) your consent given at registration and (b) our legitimate interest in operating an evaluator programme. Full details of categories collected, recipients, retention, and your rights as a data subject are documented in the Privacy Policy.

Voluntary participation: you may withdraw from the beta programme at any time and request deletion of your personal data by emailing contact@turbinex.app. We will action deletion requests within 30 days, subject to retention obligations imposed by applicable law and to anonymised aggregates we retain for product analytics.

8. Acceptable use

Beta Evaluators agree not to: (a) submit results produced on TurbineX to a certification body or commercial counterparty without independent validation against an established methodology; (b) publish benchmark comparisons against TurbineX, its solvers, or other commercial simulation tools without our prior written consent; (c) attempt to disrupt, overload, or reverse-engineer the service; or (d) use the service for any unlawful purpose. The standard acceptable-use limits in the general Terms of Service also apply.

9. Feedback licence

Any feedback, bug reports, feature requests, or suggestions you provide are non-confidential and may be used by TurbineX without restriction or attribution to improve the product. You retain any independent intellectual-property rights you already hold; this clause only grants us a licence to act on what you tell us.

10. Intellectual property and confidentiality

You retain ownership of your input data, configurations, and the simulation outputs derived from them. TurbineX retains ownership of the platform, solver builds, and documentation.

Confidential Information includes, without limitation, the platform's designs, specifications, performance data, benchmark results, non-public roadmap, beta features, pricing, and any other non-public platform information disclosed to you in connection with the beta programme. You must keep all Confidential Information in confidence, must not disclose it to any third party without our prior written consent, and must take reasonable security precautions to prevent unauthorised access or disclosure — at minimum the same degree of care you take with your own confidential information of similar sensitivity.

11. Disclaimer of warranty

The beta service is provided "as is" and "as available" without warranty of any kind, express or implied. Simulation outputs are engineering aids that must be validated against your own methodology before being used for certification, procurement, or any other commercial decision.

12. Limitation of liability

To the maximum extent permitted by law, TurbineX's aggregate liability arising out of or in connection with your beta use is capped at the amounts you have paid us during the beta period (which, for complimentary access, is zero). Nothing in these terms limits liability that cannot be limited under applicable law.

13. Termination

Either party may terminate the evaluation at any time. On termination you will have a 14-day window to export your data via the documented export paths, after which we may delete the account and its associated data. Sections 3 (Licence to use), 9 (Feedback licence), 10 (Intellectual property and confidentiality), 11 (Disclaimer of warranty), and 12 (Limitation of liability) survive termination.

14. Transition to general availability

When TurbineX leaves beta and publishes its general-availability terms, these Beta Evaluator Terms expire and continued use of the service is governed by the published general terms. We will give you at least 30 days' notice before that transition takes effect.

15. Modifications to these terms

We may update these terms from time to time. For material changes we will give Beta Evaluators at least 30 days' notice by email to the registered address before the changes take effect. Continued use of the service after the effective date constitutes acceptance of the updated terms; if you do not accept, your remedy is to terminate under Section 13. We reserve the right to discontinue the beta programme at any time, in which case the termination procedures in Section 13 apply.

16. Governing law

TurbineX is operated by Parametrica Research & Analytics SINGLE MEMBER PRIVATE COMPANY, registered in Greece. These terms are governed by and construed in accordance with the laws of Greece, without regard to its conflict-of-laws principles. Any disputes arising under or in connection with these terms are subject to the exclusive jurisdiction of the competent courts of Athens, Greece.
